Terms of Service

1. Acceptance of Terms

By creating an account or using the Create Your Desire platform (the "Service"), you agree to these Terms of Service ("Terms") and all associated policies (Privacy Policy and Cookie Policy). If you do not agree, you must not use the Service. We may update these Terms from time to time by posting the revised Terms on our site. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

2. Eligibility (18+ Only)

Age Requirement: The Service is intended for adults only. You must be at least 18 years old to register or use Create Your Desire. By signing up, you represent and warrant that you are 18 or older. We do not allow accounts for anyone under 18, and we do not knowingly collect data from minors. If we discover an account is associated with someone under 18, we will terminate the account and delete associated data. You are also required to confirm your age during signup (e.g. via an age confirmation checkbox and timestamp log).

3. Account Registration and Security

When you register, you must provide a valid email address and create a secure password. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current information and to keep it updated.

Account Responsibility: You are responsible for any content or actions that occur under your account. If you suspect unauthorized use of your account, notify us immediately at support@createyourdesire.com.au or info@createyourdesire.com.au. You must not share your login credentials or allow others to use your account. Each account is meant for a single user or organization and should not be transferred without our consent.

4. Subscription Plans and Payment Terms

We offer subscription-based access to the Service with different tiers (Starter, Pro, Enterprise). By subscribing, you authorize us (and our payment processor, Stripe) to charge your provided payment method for the recurring subscription fees and any applicable taxes. All payments are processed securely by Stripe; we do not store your credit card details on our servers.

Subscription Billing: Subscriptions are billed in advance on a monthly (or otherwise stated) cycle. Your subscription will automatically renew at the end of each billing period unless you cancel beforehand.

Trial Period: If you sign up for a 14-day free trial (available for the Pro tier), you will not be charged during the trial. To avoid being charged, you must cancel before the trial ends. If not canceled, the subscription will convert to a paid plan and the card on file will be charged the subscription fee.

5. Cancellation and Refund Policy

You may cancel your subscription at any time via your account settings or by contacting support. Upon cancellation, your account will remain active at the current service level until the end of the paid billing period, after which it will downgrade or close.

No Refunds: All subscription fees and charges are final and non-refundable. We do not provide refunds or credits for partial subscription periods, unused services, or downgrades. This no-refund policy applies to all subscription tiers, including cases of early cancellation. The only exceptions are if a refund is required by law or if we, in our sole discretion, decide to issue a refund in extraordinary circumstances. If you believe you have a special case, you can contact us, but note that issuing refunds or credits is not our standard policy.

6. User Content and Conduct

6.1 User-Provided Content

Our Service allows you to upload or provide content such as photos (for "Self Models"), profile information, and custom text inputs (collectively, "User Content").

Ownership of User Content: You retain ownership of any original content (e.g. photos, text) you upload to the platform. By uploading or submitting User Content, you grant Create Your Desire a worldwide, royalty-free license to use, reproduce, modify, and display your content only as needed to provide and improve the Service. This includes, for example, processing your photos to create AI personas, using your input text to generate content, and displaying your avatars or profile information within the app. We will not use your User Content for unrelated purposes without your permission. You are solely responsible for the content you provide and must ensure you have the necessary rights to upload it.

Prohibited Content: You agree not to upload any User Content that violates these Terms or any applicable law, including content that is illegal, infringing, or harmful (see Prohibited Uses in section 8).

6.2 AI-Generated Content

As part of the Service, our AI models generate text and image content ("AI-Generated Content") based on your prompts, persona configurations, or self-models.

Ownership of AI Outputs: All AI-Generated Content produced by our Service is considered part of the Service's content. Create Your Desire retains ownership and intellectual property rights over the AI-Generated Content produced on the platform. However, we grant you a license to use the AI-Generated Content for your personal use and legitimate business purposes (for example, you may use the AI-generated images and text to engage with fans or to post on your linked accounts). This license is non-exclusive, worldwide, and royalty-free, and lasts as long as you have a valid account with us. You may not claim ownership of the AI-Generated Content or attempt to register any intellectual property rights (such as copyright or trademark) in such content. Keep in mind that AI-generated works may not qualify for copyright protection under some jurisdictions' laws, and any use of them is at your own risk. We reserve the right to use any AI-Generated Content internally for Service improvement, quality control, or compliance with our policies. We will not use your AI-generated persona content for our marketing or other external purposes without your consent.

6.3 Platform Intellectual Property

All software, code, algorithms, models, and infrastructure provided as part of the Service are the exclusive property of Create Your Desire (or its licensors). Our trademarks, logo, and branding are also our intellectual property. We only grant you a limited, revocable right to use the Service for its intended purpose under these Terms. You must not copy, distribute, modify, or create derivative works from our platform or content except as explicitly allowed. No Reverse Engineering: You agree not to reverse engineer, decompile, or attempt to extract the source code or underlying algorithms of any part of the Service, nor use the Service to develop a competing product. If you provide feedback or suggestions, we may use them without obligation to you.

7. Prohibited Uses and Content

You must use the Service responsibly. You agree not to misuse the platform or engage in activities that harm others or the Service. In particular, you are strictly prohibited from using the site or Service (including all content tools) in any of the following ways:

  • Illegal Purposes: No unlawful use. You may not use the Service for any purpose that is illegal or to further any illegal activity. This includes content or conduct that violates any law or regulation (international, federal, state, or local).
  • Exploitation or Non-Consensual Content: You may not create or share content that depicts or encourages minors (under 18) in any capacity, or any non-consensual activities. All adult content must involve consenting adults only. Absolutely no child sexual abuse material, sexualization of minors, or content depicting individuals without their consent is allowed.
  • Personal Harm or Harassment: You may not harass, bully, or threaten other people. This includes content that is defamatory, abusive, hateful, or encourages self-harm or violence. Do not use the Service to target or discriminate against anyone on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin, disability, or other protected characteristics.
  • Platform Integrity: Do not solicit personal information from other users for nefarious purposes, or encourage users to engage in off-platform meetings or transactions that could put them at risk. You may not use the Service to share your or others' personal contact information for dating or in-person meetups. The platform is intended for virtual content engagement only.
  • Intellectual Property Infringement: Do not use the Service to upload or generate content that infringes upon the intellectual property rights of others (e.g. copyrighted material you do not have rights to, someone else's likeness or trademark used without permission). You should only upload photos of yourself or content you have the rights to use.
  • False Information and Fraud: You must not impersonate any person or entity or submit false or misleading information. Do not use the Service for fraudulent schemes, phishing, or to deceive others.
  • Malware and Hacking: You may not upload viruses, worms, or any malicious code, or take any action that could disable, overburden, or impair the Service's infrastructure. This includes attempting to hack or gain unauthorized access to the Service or other users' accounts, and refraining from any form of automated scraping or data extraction of the Service without our permission.
  • Spam and Unauthorized Solicitations: No spamming, unsolicited advertising, or sending mass messages through our platform. You may not use the Service to advertise third-party products or services to other users unless explicitly permitted.
  • Circumventing Security or Moderation: You shall not attempt to bypass any content filters, security measures, or access controls put in place by the platform. This includes trying to use the AI to generate disallowed content by tricking it or using external tools to interfere with our moderation systems.
  • Other Harmful Activities: Any other use of the Service that we deem harmful, exploitative, or objectionable in our sole discretion. This includes using the Service for obscene or extremely graphic content beyond the allowed adult scope, or any purpose that could bring risk to the platform or its users.

We reserve the right to suspend or terminate your account if you engage in any of the above prohibited activities or otherwise violate these Terms. Serious violations (such as those involving illegal content) may be reported to law enforcement. We also reserve the right to remove or block any content that violates these rules or that we find inappropriate, with or without notice.

8. Content Moderation

All AI-generated content on Create Your Desire is subject to moderation to ensure compliance with these Terms and our content standards.

Automated and Human Review: We utilize automated systems (such as OpenAI's Moderation API) to screen content for prohibited material, and we also employ human moderators to review AI-generated outputs. Any content you attempt to generate that is flagged by our systems or moderators as violating our guidelines will be blocked or removed. You acknowledge that content moderation may cause some of your requested AI outputs to be refused or edited for safety reasons.

Approval Queue: AI-generated content (text or images) may be held in a review queue and require explicit human approval before it becomes accessible or visible to you or others. We strive to review content promptly, but delays are possible. If content is disapproved, it will not be delivered, and we may notify you that it violated policy.

We maintain an audit trail of moderation decisions for compliance and safety auditing. Repeated attempts to generate disallowed content or circumvent filters can result in warnings or account termination. Our decision on content moderation is final. However, if you believe your content was wrongly flagged, you can contact support to request a second look. We still make no guarantees that all objectionable content will be caught. You understand that by using an AI content platform, you may inadvertently be exposed to content that slips through moderation; Create Your Desire is not liable for content generated by the AI that you find offensive or harmful (though we will do our best to prevent such occurrences).

9. Account Termination

By You: You may terminate your account at any time if you no longer wish to use the Service. You can do this via an account deletion option (if available in settings) or by contacting us at our support email. Account deletion is subject to our data retention policy (see Privacy Policy for details on what data may be retained after deletion). Terminating your account will cancel any active subscriptions (effective at the end of the current billing cycle) and remove your access to the Service.

By Us: We reserve the right to suspend or terminate your account (or access to certain features) at our sole discretion for any violation of these Terms or if we suspect your use of the Service creates risk or legal exposure for us. We may also suspend the Service or any account during investigation of a potential violation. In cases of severe violations or illegal content, termination may be immediate and without prior notice. In most cases, we will attempt to notify you of the termination or suspension, along with the reason. If your account is terminated due to a breach of the Terms or unlawful conduct, you will not be entitled to any refunds for any unused subscription period.

Upon termination for any reason: your right to access or use the Service will cease, and we may delete or disable access to your content (including AI-generated content and any stored user data) after a retention period. We are not obligated to keep your content or data after account termination, except as required by law. Sections of these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers, and liability limitations) will continue to apply.

10. Disclaimers

Use at Your Own Risk: The Create Your Desire platform provides AI-generated personas and content for your use. While we strive for high-quality, the Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the AI-generated content will meet your expectations or be error-free. The AI may occasionally produce inaccurate information or content that you find undesirable. You acknowledge that any reliance on the outputs of the AI is at your own risk. The Service is for entertainment and content creation purposes; it is not professional advice.

No Warranty: To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Service and content. This includes warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors or harmful components, or that any defects will be corrected. While we aim to maintain a safe and secure platform, we cannot guarantee that our site or servers are immune from viruses or hacking. You are responsible for implementing protections (like antivirus software) on your own systems.

Third-Party Services: Certain features of our Service rely on third-party providers (for example, Stripe for payments, OpenAI or Stability AI for content generation, Google for photo analysis, or an optional OnlyFans integration via a third-party API). We do not have control over these third-party services and thus make no guarantees regarding their availability or performance. Use of third-party services may be subject to their own terms and privacy policies. We are not responsible for any issues or losses arising from the actions or inactions of third-party providers. For example, if a payment processor fails to process a payment or if an AI API fails or produces problematic output, Create Your Desire is not liable for those external failures.

11. Limitation of Liability

To the maximum extent permitted by law, Create Your Desire (and its owners, officers, employees, and affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. This limitation applies to any claims arising out of your use of (or inability to use) the Service or any conduct or content of any third party on the Service. We are not liable for content you generate or encounter through the Service, nor for interactions between users and any third-party platforms you integrate with (such as OnlyFans).

In no event shall our total liability to you for all claims arising out of or relating to these Terms or the Service exceed the amount you have paid to us for the Service in the three (3) months immediately preceding the event that gave rise to the claim (or, if greater, USD $100). Australian Consumer Law Notice: Nothing in these Terms is intended to exclude or restrict any rights you have under the Australian Consumer Law or other applicable laws that cannot be excluded. If you are a consumer as defined under Australian law, you may be entitled to certain guarantees and remedies which cannot be excluded; these Terms apply subject to those non-excludable rights.

12. Copyright Infringement (DMCA)

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA) where applicable. If you believe that any content on our platform infringes your copyright, please notify our designated copyright agent at info@createyourdesire.com.au with the subject "DMCA Notice." Your notice should include: (a) identification of the copyrighted work you claim is infringed, (b) identification of the content on our site that you claim is infringing (with URL or description sufficient to locate it), (c) your contact information (name, address, email, phone), (d) a statement that you have a good-faith belief that the disputed use is not authorized, (e) a statement under penalty of perjury that your notice is accurate and that you are the copyright owner or authorized to act on their behalf, and (f) your electronic or physical signature.

Upon receiving a valid DMCA notice, we will promptly investigate and remove or disable the allegedly infringing content and notify the affected user. We also maintain a policy to terminate accounts of repeat infringers in appropriate circumstances. If you believe your content was removed by mistake or misidentification, you may submit a counter-notification per DMCA guidelines. Please note that knowingly submitting a false DMCA notice or counter-notice could make you liable for damages.

13. Governing Law and Dispute Resolution

These Terms and your use of the Service are governed by the laws of Queensland, Australia. You agree that any dispute or claim arising out of or related to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Queensland, Australia. If you are accessing or using the Service from outside Australia, you do so on your own initiative and are responsible for compliance with local laws if and to the extent they apply. Nothing in this section limits any rights you may have under mandatory consumer laws, including Australian Consumer Law, where applicable. In the event of a dispute, we encourage you to contact us first to seek an amicable resolution.

14. Changes to These Terms

We may modify or update these Terms of Service from time to time. If we make material changes, we will provide notice by posting the updated Terms on our website and updating the "Last Updated" date above. In some cases, we may also notify you via the email associated with your account or via an in-app notification. It is your responsibility to review these Terms periodically. Continued use of the Service after updated Terms are in effect will constitute your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and, if applicable, cancel your subscription.

15. Miscellaneous

Entire Agreement: These Terms, along with the Privacy Policy and Cookie Policy and any additional terms you agree to when using specific features (if any), constitute the entire agreement between you and Create Your Desire regarding the Service. They supersede any prior agreements or communications.

No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full effect.

Assignment: You may not assign or transfer your account or any rights under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger or acquisition.

No Agency: No joint venture, partnership, employment, or agency relationship is created between you and us as a result of these Terms or your use of the Service.
